Fuel Mix Regulations

On the 26th June 2003 the European Parliament published a Directive that included requirements for each Member State to require each electricity supplier to publish the mix of fuels in the electricity it supplies.

The Directive is known as 2003/54/EC and the Article relating to this information is 3(6).

Following this, on the 23rd July 2004, The Secretary of State for Trade and Industry stated that she would to implement Article 3(6) requirement by way of a new supply licence condition introduced by means of regulations under section 2(2) of the European Communities Act.

Thereafter on the 5th August 2004 a workshop was held at OFGEM’s offices to discuss the implications of the requirement.

Interested parties were invited to provide a formal response to The Secretary of States’ proposed amendments by the 31st August 2006. A number of suppliers and other interested parties responded.

On the 19th November 2004, OFGEM published “Summary of responses and revised draft licence condition November 2004 256/04”

On the 9th June 2005 OFGEM published “Fuel Mix Disclosure by Suppliers in Great Britain Draft Guidelines June 2005 146/05”

On the 16th December 2005, OFGEM published “Fuel Mix Disclosure by Electricity Suppliers in Great Britain Guidelines December 2005” Although the new licence condition had been introduced on the 18th March 2005 the actual guidelines for implementation of the requirement were now available for the first time.
